Disadvantaged Business Enterprise (DBE) Program Compliance

The Disadvantaged Business Enterprise (DBE) program ensures equal opportunity in transportation contracting opportunities, addresses the effects of discrimination in transportation contracting and promotes increased participation in federally funded contracts by small, socially and economically disadvantaged businesses, including minority- and women-owned enterprises. The DBE Program is a federal requirement under 49CFR part 26 for recipients of federal funds with $250,000 or more in contracting opportunities (excluding bus vehicle purchases). The CapMetro DBE program is recognized as one of the best-implemented programs across the industry.

In addition, the DBE program implementation requires extensive attention to contract compliance. Office of Diversity staff is involved in the procurement process from beginning to end, starting with setting DBE goals for federally funded procurements, evaluation of the submitted procurements for DBE compliance and close monitoring of the contracts once they have been awarded.

Small Business Enterprise (SBE) program

CapMetro's Small Business Program applies to both federal and locally funded projects. For federally funded projects, the SBE program component follows federal guidelines under 49 CFR Part 26.39 as concurred by the Federal Transit Administration (FTA). For locally funded projects, CapMetro developed a Small Business program to be inclusive of all small businesses and maximize small business participation.

CapMetro defines small businesses as any business whose annual gross income averaged over the past 3 years does not exceed the Small Business Administration's (SBA) size standards as set forth in 13 CFR, Part 121. A size standard is the largest that a firm can be and still qualify as a small business.

CapMetro's SBE program provides full and fair opportunities for equal participation by small businesses at CapMetro. The program is broad in order to create opportunities, require competitiveness and assist SBEs in overcoming potential barriers to participating in contracting opportunities. The SBE program promotes and encourages SBEs to participate in procurement opportunities and encourages bidders to include certified SBEs in subcontracting opportunities.

The Office of Diversity staff assigns small business goals to procurement opportunities as is necessary and proper to increase the level of small business participation across all CapMetro projects.


Equal Employment Opportunity (EEO) Program Compliance

The Federal Transit Laws, 49 U.S.C. 5332(b), provides that "no person in the United States shall on the grounds of race, color, religion, national origin, sex, or age be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any project, program or activity funded in whole or in part through financial assistance under this Act."  This applies to employment and business opportunities and is considered to be in addition to the provisions of Title VI of the Civil Rights Act of 1964.

CapMetro and Title VI Compliance

Title VI, 42 U.S.C. § 2000d et seq, was enacted as part of the Civil Rights Act of 1964. It prohibits discrimination on the basis of race, color or national origin in programs and activities receiving federal financial assistance.

Compliance with Title VI of the Civil Rights Act of 1964 is a federal mandate for all agencies providing public services. Title VI applies to all aspects of the services provided by CapMetro, which are required to be provided without regard to race, color or national origin. In addition, agencies must also comply with Executive Order 13166, "Improving Access to Services for Persons with Limited English Proficiency."

CapMetro is required to comply with Title VI by evaluating major service changes and their Title VI impacts on minority and low-income groups. (This evaluation is called a service equity analysis, and it helps CapMetro determine if the effect of a service change is discriminatory. 

CapMetro’s Title VI goal is for minority and low-income populations to receive at least their share of the benefits in the case of a net service increase, and no more than their share of the adverse effects, in the case of net service reductions.

Capital Metropolitan Transportation Authority is committed to ensuring that no person is excluded from participation in or denied the benefits of its services on the basis of race, color or national origin, as protected by Title VI of the Civil Rights Act of 1964, as amended (“Title VI”).

If you believe you have been discriminated against on the basis of race, color, or national origin, you may file a complaint with CapMetro by completing CapMetro’s Title VI complaint form and submitting it by:

CapMetro investigates completed complaints on the Title VI Complaint Form that are received no more than 180 days after the alleged incident.

CapMetro will take the following steps once a complaint is received:

  1. The complaint is reviewed by the Office of Diversity Equity and Inclusion (DEI) to determine if CapMetro has jurisdiction. CapMetro will provide a letter informing the complainant whether the complaint will be investigated within 15 calendar days of receipt of the complaint.
  2. CapMetro will use its best efforts to investigate the complaint within 90 calendar days of its receipt. If additional information is needed, the Office of DEI will contact the complainant by phone or in writing. Failure of the complainant to respond within 15 calendar days of the request for information may result in the administrative closure of the complaint. A case can be administratively closed also if the complainant no longer wishes to pursue their case.
  3. CapMetro will issue one of the following determination letters:
    • A closure letter that states that there was not a Title VI violation and that the case will be closed.
    • A letter of finding that explains whether any disciplinary action, additional training, or other action will occur.
